Who we are
These Terms of Service (the "Terms") govern your use of Pulsaria, a
local-first KPI tracking application for macOS and iOS, and the
associated website at
pulsaria-kpi.com (together, the "Service").

By downloading, installing, or using Pulsaria, you agree to these Terms. If you do not agree, do not use the Service.

Licence grant
Subject to these Terms and full payment of the applicable licence fee, One Pixel Ahead grants you a personal, non-exclusive, non-transferable, worldwide licence to install and use Pulsaria for your own purposes — private or commercial.
A single licence may be activated on up to three (3) Apple devices owned or controlled by you. You may deactivate any activation at any time to free a slot.
The licence covers all updates within the same major version (1.x). If we ever release a new major version (e.g. 2.0), it will be a separate purchase, offered at a discount to existing licence holders. Your 1.x licence will continue to function for as long as macOS supports it.

Free trial
Pulsaria includes a 14-day free trial. No credit card is required to start the trial. After the trial period ends, the application switches to read-only mode — your data remains visible, but new entries cannot be added until you purchase a licence.

Restrictions
You may not:
- resell, rent, lease, sublicense, or otherwise commercially redistribute Pulsaria;
- decompile, reverse-engineer, disassemble, or attempt to derive the source code of the application, except to the extent expressly permitted by applicable law;
- remove, alter, or obscure copyright notices, trademarks, or proprietary markings;
- use Pulsaria for any unlawful purpose or in any way that infringes the rights of third parties;
- circumvent or attempt to circumvent the licensing or activation mechanism.

Your data
Pulsaria runs locally on your devices. All KPI data, entries, and logs are stored as JSON files on disk under your control. We never receive a copy of your data, because there is no server-side component.
If you choose to enable iCloud synchronisation, your data is synced between your devices through Apple's iCloud Drive. We are not party to that sync relationship — Apple is. Please review Apple's privacy documentation for details.
You are responsible for backups. Although Pulsaria stores everything as plain JSON files that work with standard backup tools, we strongly recommend keeping regular backups (e.g. via Time Machine).

Intellectual property
Pulsaria, including all related code, designs, trademarks, and documentation, is the intellectual property of One Pixel Ahead UG and its licensors. These Terms grant you a licence to use the Service — they do not transfer ownership of any intellectual property.

Payment and refunds
Purchases are processed by Paddle.com Market Limited, who acts as the Merchant of Record. Paddle is responsible for collecting payment, applying applicable taxes, and issuing invoices. Payment is governed by Paddle's own terms in addition to these Terms.
Refund eligibility, process, and timelines are set out in our separate Refund Policy, which forms part of these Terms.

Updates and discontinuation
We may release updates, bug fixes, and new features at our discretion. You are not required to install every update, but we may stop supporting older versions over time.
We may discontinue the Service at any time. If we do, your last purchased version will continue to function on supported operating systems — there is no server component that can be shut down. You will retain access to all your locally stored data.

Disclaimer of warranties
To the maximum extent permitted by applicable law, Pulsaria is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your specific requirements. Statutory rights of consumers under mandatory law remain unaffected.

Limitation of liability
To the extent permitted by law, One Pixel Ahead shall only be liable for damages caused intentionally or by gross negligence, or for damages resulting from injury to life, body, or health.
For damages caused by simple negligence, our liability is limited to breaches of essential contractual obligations and is capped at the amount you paid for your Pulsaria licence in the twelve (12) months preceding the event giving rise to the claim.
We are not liable for indirect, incidental, or consequential damages, including but not limited to loss of data, loss of profit, or business interruption, except where mandatory law provides otherwise. You are responsible for maintaining backups of your data.

Termination
You may stop using Pulsaria at any time by uninstalling the application. Your locally stored data remains yours.
We may terminate your licence and your access to the Service if you materially breach these Terms and fail to remedy the breach within a reasonable period after we notify you. On termination, you must cease all use of the Service. Sections 06 (Intellectual property), 09 (Disclaimer), 10 (Limitation of liability), and 13 (Governing law) survive termination.

Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will give reasonable notice — for example by emailing registered licence holders or by posting a notice on the website. Continued use of Pulsaria after the changes take effect constitutes acceptance of the revised Terms.

Governing law and jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers domiciled in the EU, mandatory consumer-protection laws of their country of residence remain unaffected.
The exclusive place of jurisdiction for disputes with merchants, legal entities under public law, or special funds under public law is Deggendorf, Germany.
